These Online Terms and Conditions of Trading ("terms") apply to all contracts between You/your ("the Customer") and we/us/our ("James Kearns Ltd").
These terms relate to sales over the Internet only. We reserve the right to alter these terms at any time and without notice to you. Nothing within these terms and conditions shall affect you/your the buyer’s statutory rights as a consumer.

Payments can only be made via two methods. Paypal with the email address JameskLLs@hotmail.com and via Bank Transfer into NatWest James Kearns LTD
GENERAL
The contract made by you with us (James Kearns Ltd) online via (www.jameskearns.co.uk) incorporates the following terms. These terms shall prevail over any and all terms, proposed by you.
To proceed with any and every purchase through our site (www.jameskearns.co.uk) you have to read and agree to these terms of use.
It is advised that you print out these online terms and conditions and keep them for your personal records.
By accepting the delivery of the goods, it shall then be deemed as evidence of you the buyer, fully accepting these terms and conditions.
We (www.jameskearns.co.uk) reserve the right to update and/or change prices and products on the web site at any given time.
We shall not be liable to anyone for withdrawing any goods or services from the website, and shall have the right and not be liable for refusing to process an order.
Throughout the site, all our pricing is in GBP (British pounds £) and includes VAT (value added tax).
VAT refunds shall be given to those eligible to receive them. We reserve the right to adjust the VAT if it changes.
All information within the site is as accurate as possible, but could also be prone to error. Although prices and descriptions could change over time and through this there could be errors. All errors incurred shall be rectified immediately, once brought to our attention. We are not liable for any losses that may occur.
We reserve the right to change/amend the descriptions/specifications of our products. On occasion the products that are supplied could differ from those that are displayed within the site. If this should occur, you shall be informed of the change/amendment. Then be given the option to cancel the purchase or reselect in accordance with our policy

This shall not affect the existing terms and conditions accepted by you/your the buyer upon making a purchase via our web site. We reserve the right to restrict, suspend or terminate your use of this site at any time without any prior warning.

Images and graphics have been created in house, by the web design team and/or have been obtained with permission to be used within the site.
Nothing within the site may be copied and/or used without prior consent from us. Any unauthorized use of any of the above shall result in copyright infringement.
RETURNS/EXCHANGE POLICY
Any unsuitable items may be refunded or exchanged if they reach us within 28 days of our dispatch date. Before you return something you must notify us within 48 hours that you wish to return an item by emailing us at james@jameskearns.co.uk.
When returning the product, please ensure that you include your original receipt in the returned parcel. If you need any further assistance or information in regards to our policy please email james@jameskearns.co.uk or call TBC.
James Kearns Ltd will only exchange an item for the same item in a different size, subject to availability, if a different garment is desired you must place this as a new order. Returns received after the 28 days’ time frame are accepted at the discretion of James Kearns Ltd and can only be refunded with a 'store credit note' which can be used online. We reserve the right to refuse a return or exchange if the garment does not have all its original packaging, labels, and tags, and if we deem the garment to have been worn or damaged.
If you wish to receive a refund we will re-credit the original purchaser's credit card for the sum paid less any taxes and duties and less the postal costs. It is advisable to send returned items by registered post, DHL or any other trusted courier service. Be sure to keep your receipt and ask for a tracking number, as we cannot be responsible for goods lost or damaged in transit.
Please note that postal costs for returned goods are the customer’s responsibility. We shall only reimburse you only if the product is damaged, faulty or has been incorrectly supplied.

At the moment James Kearns Ltd only accepts PayPal. (www.paypal.com) You can use most major credit/debit cards through PayPal.
DELIVERY
We endeavor to deliver your selected products to you and/or your destination of choice in the fastest and safest way, and arriving in perfect condition. We deliver around the world using the courier service UPS. Once the product has been dispatched you shall be sent an email containing a confirmation of your order and your delivery tracking number. Orders shall be dispatched within 1-3 working days subject to credit clearance, address verification and availability of items. We will contact you if there is any kind of delay or items are out of stock, if it is not already stated on the website.
OVERSEAS ORDERING
James Kearns Ltd does not charge any custom duties or any other fees on international shipments. If you incur any additional charges, they are not the responsibility of James Kearns Ltd. We advise that you check your local customs laws/policies so as not to incur charges unknowingly.

Please be aware if you are ordering from a non-EU country, your VAT refund will be calculated at the summary page, once you register for the purchase. Note, due to administration fees your refund is not going to be the full 17.5%.

All private/personal information is handled and stored in a safe and responsible manner. No information regarding private/personal details shall ever be disclosed to third parties, and shall only be used by James Kearns Ltd. for the following:
